Android has 40 percent of U.S. smartphone market despite patent troubles

Google made quite a stink this week about the patent situation in the U.S. and what it feels are anti-competitive practices by other players in the smartphone industry. Google shouldn't have too much to complain about, though, as comScore's latest report on the smartphone market places Android in the pole position, with a nearly 15 point lead over its nearest rival - Apple.
