ANDA litigation remains one of the most demanding areas of patent law, where outcomes often hinge on the experience and judgment of individual attorneys. In disputes that determine when a generic drug can enter the market, the role of lead counsel is especially critical. Some attorneys consistently handle a high volume of ANDA cases through complex procedural paths and deliver results across multiple matters.

Today’s insight highlights the top ANDA attorneys in 2025, based on measured activity and performance drawn from recent litigation data. Rather than focusing on reputation, the analysis looks at who is actively involved in ANDA disputes and how often their cases result in successful outcomes.

Key Observations From ANDA Litigation in 2025

To address the demand for clear, data-driven insights into ANDA litigation, Patexia publishes its annual ANDA Litigation Report. The 2025 edition examines the past five years of filings, stakeholders' activity, and case outcomes, highlighting the most engaged practitioners and revealing patterns that define the current state of Hatch-Waxman disputes.

Filing trends: Between July 1, 2020, and June 30, 2025, a total of 1,373 ANDA cases were filed. Annual filings increased from 246 in 2021 to 263 in 2022, remained steady at 262 in 2023, and peaked at 317 in 2024. The first half of 2025 recorded 155 cases, putting the year on track to approach 300 filings, based on the consistent monthly average of 25–27 cases seen in recent years.

Attorney activity: The report evaluated 1,574 attorneys, including 235 local counsel, who were active in at least one ANDA litigation case filed over the past five years. Each attorney was evaluated based on three measures: Activity, Success, and Performance, using Patexia’s established methodology.

Terminations and outcomes: Before the report was published, 965 ANDA cases had been resolved. Of these, 54.8% ended in dismissals (voluntary, settled, or otherwise), 31.1% concluded with a judgment, 3.5% were transferred or remanded, and the remaining cases closed administratively. This demonstrates that most Hatch-Waxman disputes are resolved without a formal court ruling.
