Patexia Insight 234: Who’s Winning and Filing Most? 2025’s Top Patent Litigation Companies

Patent Litigation

In the high-stakes world of intellectual property, patents are more than legal protections—they’re sometimes million-dollar chess pieces in a global game of innovation dominance. As companies race to secure patents over breakthroughs in high-tech and biotech, patent litigation has become their ultimate battleground. However, not all players litigate in the same way. While some prioritize winning big (think nine-figure damages and market-blocking injunctions), others take a high-volume approach, strategically filing numerous lawsuits and keeping rivals on the defensive through sheer volume.

In this article, we unveil the top five best-performing and most active plaintiff and defendant companies in patent litigation for 2025, based on insights from Patexia’s Patent Litigation Intelligence Report. Whether you’re protecting your intellectual property or pursuing growth through enforcement, these industry leaders provide a blueprint for leveraging patents as a strategic advantage.

The year 2024 marked a reversal in patent litigation trends, with 3,683 unique cases filed—a notable uptick from 2023 and the first increase since the post-pandemic peak of 3,953 cases in 2021. But raw case numbers only scratch the surface. The Patent Litigation Intelligence 2025 report dives deeper, analyzing 17,342 litigated patents to serve as a strategic playbook for navigating the new era of patent litigation. It identifies the dominant technologies through IPC codes, highlights the most active courts and judges, and analyzes case durations. It also tracks key geographic hotspots—such as Texas, California, and Delaware—offering insights into the shifts in patent litigation.

Furthermore, we have analyzed the outcomes of each terminated case. Beyond the “where” and “what,” the report evaluates and ranks 42,351 companies, 3,186 firms, and 14,954 attorneys by activity and performance, with separate leaderboards for plaintiffs, defendants, and overall. Our ranking methodology considers key metrics such as cases filed, patents litigated, success rates, and case outcomes, ensuring a data-driven evaluation of litigation impact.
