Patexia Concierge Benefits

Patexia Concierge was designed in response to the increasing need of IP attorneys for IP insights and analytics. This annual subscription program entails a number of services from online tools to canned and custom reports including:

The subscription is for the entire organization and every employee with an email address carrying the domain of that organization will automatically gain access to the Subscription-Only content.

Login and Access to the Site

If your organization is already a member of Patexia Concierge, you can easily access the site by signing up using your organization’s email address here:

Once you enter your information in the above link, you will receive a confirmation email. Make sure to enter the correct email address and double check your spam folder in case you have not received the email. 

Once you confirm your email (via the link provided in the email), you will continue with the signup process and complete the remaining steps.

Make sure that you are always logged in, before using any of the subscription-only content. If you are logged in, your name (and photo) should appear at the top right corner of the screen.

IP Insights Reports

As a member of the Patexia Concierge Program, you automatically gain access to Patexia IP Insights reports. For the time being, there are only two reports available:

We plan to release the District Court Patent Litigation Report in late 2019. When released, it will automatically become available to all our Concierge Members. 

Downloading the reports

There are currently two ways to download the reports. You can either download them directly from the report page under IP Insights by clicking on the “Details” button for the latest report:

Law Firm Profiles

Patexia has created a profile for more than 20,000 US-based and international law firms. These profiles are generated and updated on a daily basis, using publicly available data we obtain from USPTO, PTAB, and PACER. Attorneys can also directly update their cases which will be indexed and used to update the law firm pages later.

The content for each law firm is organized under six tabs. 

 

 

At the top, you will see the logo of the firm, their total number of IP Attorneys and patent agents, the top three cities with the highest concentration of their IP team and the URL for the law firm. Then you will see the following six tabs for each firm:

General Tab

This tab is part of our free content and is available to any user (with or without subscription access). It summarizes the firm, company or attorney’s practice areas.

It includes five separate modules that summarize the content under each of the other five tabs (Practitioners, Litigation, Prosecution, Careers, and News). See below for more.

Practitioner Tab

We regularly crawl USPTO registered patent attorneys and patent agents to update our database of all registered IP professionals. The data is then cleaned and assigned to different law firms or companies based on what is provided by the hiring organization to the US Patent and Trademark Office. 

Besides the USPTO content, we also crawl and clean the attorney data from other sources such as PACER or PTAB. However, not all the attorneys under other sources are registered patent attorneys but because of their involvement (e.g., as a trial attorney) in IP cases, we have identified them as IP professionals. 

The content is constantly reviewed either automatically or manually by our staff to ensure the highest quality possible. This includes a review of the IP professional’s title (e.g., Associate, Partner, Agent,  Counsel, …), location of work (Address), etc.

We also include the total number of cases (PTAB, District Courts, ITC, etc.) related to patent that we can identify and assign to that professional.

Litigation Tab (Subscription-Only)

The content under this tab is only available under our subscription programs. It includes numerous charts and a list of all cases related to district court litigation, PTAB, and ITC that we have identified and associated with that law firm, company or individual. 

At the top of the page, we summarize the litigation activity of that individual or entity (law firm or company) over the last five years. This includes the total volume of cases, as well as the percentage of different roles for that entity (e.g., a law firm representing its clients on the defense side, …).

Below the summary box, there are several charts, illustrating some statistics related to the litigation activity of the individual, law firm or company over the last five years. This includes:

  • Case Count By Type - This chart summarizes the case count by type. We currently categorize the cases into five categories: District Court, IPR, CBM, PGR and ITC cases.

  • Case Count by Court - This chart summarizes the activity of the attorney, law firm or company in its top 5 litigation venues over the last five years. We currently cover all the US 50 states for district courts as well as PTAB (USPTO) and ITC. 

  • Case Count by Client - This chart summarizes the case count for the top five clients of the law firm/attorney (or law firms representing the company). 

  • Case Count by Year - This chart summarizes the case count by year for the last five years. It counts all types of cases including IPR, CBM and ITC.

 

We crawl multiple sources on a daily basis and constantly make an effort to ensure the data on the site is up to date and accurate. The users can view a list of all the cases at the bottom of the page and obtain further information by clicking on the related case they are interested in.

Prosecution Tab (Subscription-Only)

The content under this tab is only available under our subscription programs. It includes numerous charts and a list of all patents and patent applications related that we have identified and associated with that law firm, company or individual. 

 

At the top of the page, we summarize the prosecution activity of that individual or entity (law firm or company) overall as well as over the last five years. This includes the total volume of patents issued by the patent office, as well as the total number of patents over the last five years

Below the summary box, there are several charts, illustrating some statistics related to the prosecution activity of the individual, law firm or company over the last five years. This includes:

  • Patent Count By Year - This chart summarizes the patent count by year for the last five years. Patent Count by Examiner - This chart summarizes the top five most active examiners who worked on patent applications related to the attorney, firm or company.

  • Office Actions and Extensions by Year - This chart summarizes the count of office actions or time extensions requested or handled by year for the last five years. Please note that data for the last 18 months is usually incomplete as the new applications are published, 18 months from filing.

  • Issued and Abandoned by Year - This chart is an easy way to see the application allowance rate by year. It shows the total number of applications issued or abandoned by year for the last five years. Hovering over the charts will show the details including the allowance rate by year. The data for the last 12 months is not very accurate as the USPTO releases the application transaction history and examiners work, once a year.

  • Patent Count by Company/Law Firm - This chart summarizes the activity of the top five clients (for law firms) or the activity of the top five law firms (for companies). It is a very easy way to quickly understand the top five law firms representing a company or the top five clients of a law firm and their volume of work over the last five years. 

  • Prosecution Performance - This chart shows the performance metrics including activity, efficiency and success for the law firm or company over the last five years. Performance is the main metric measured for each entity, which is a weighted average of success, efficiency, and activity for each of the entities. 

 

We download patent and publication data on a weekly basis from the USPTO website. We constantly make an effort to ensure the data on the site is up to date and accurate. The users can view a list of all the patents or applications at the bottom of the page and obtain further information about each of the applications by clicking on the related application/patent they are interested in.

Careers Tab

Patexia’s recruiting division works with a number of law firms and companies to help them fill the gap in their IP departments or group by adding the right talents. What makes our recruiting operation unique, is our extensive use of data to identify the right talent. Having access to all the IP cases and patents as well as clients / law firms working on each side, makes it easier for us to filter more than 70,000 patent attorneys or agents by different parameters, such as location, seniority, type of cases (e.g., high-tech, Hatch-Waxman, etc.), client (e.g., Apple), adverse parties / conflicts (e.g., Samsung), volume of work, team size, estimated book of business, and many other parameters. 

The positions listed in the career tab are only for those law firms or companies that have signed a recruiting agreement with Patexia and directly working with our recruiting group. If there is no such relationship, the recruiting tab will be empty by default.

News Tab

The last tab on law firms and company pages is “News Tab”. This tab covers any news including opinion and analysis published by the Patexia Community, which had discussed or mentioned that law firm or company. The articles under this section is solely the opinion of the author and does not represent the opinion of Patexia. Publishing under Patexia community is currently free and any user with an account can write and publish an article. 

Since our goal is to increase the IP knowledge of our community, our internal community and content team will review all the submitted articles before publishing them, to ensure the articles are appropriate and are not direct or indirect marketing of some services or products offered by law firms and companies. 

If the company or law firm has not been mentioned in any of the community-generated content, this tab will be empty by default.

Company Profiles

Patexia has created a profile for more than 600,000 US-based and international companies, universities and government organizations. Any company that has filed a patent application or has been involved in some patent litigation has a profile on Patexia. These profiles are generated and updated on a daily basis, using publicly available data we obtain from USPTO, PTAB, and PACER.

Attorney and Agent Profiles

Patexia has created a profile for more than 70,000 US registered patent attorneys and agents. Any attorney and agent who has passed the USPTO bar exam or has been named in some patent litigation has a profile on Patexia. These profiles are generated and updated on a daily basis, using publicly available data we obtain from USPTO, PTAB, and PACER.

Examiner Profiles (Subscription-Only)

Patexia has collected and analyzed examination data for more than 15,000 USPTO examiners. You can search for all the examiners directly from the search page, here:

Every examiner has a dedicated page, providing various information including:

  • Examiner ID, 

  • Phone Number, 

  • Office Number, 

  • Art Unit(s)

  • Issued, Pending and Abandoned applications

A bar chart visually illustrates the examiners activity including issued and abandoned applications by year.
 

The basic information about each examiner is available for free. However, Patexia Concierge members have access to Subscription-Only content under the statistics tab where they can gain insights about the examination history of each examiner and compare that with the related art unit or the entire patent office. 

Allowance Rate before and after first final rejection - The first chart shows the overall Allowance Rate at the application level for each examiner as well as the allowance rate before and after the first final rejection. Hovering over the chart will show the total number of application that fell into each category. 

This simply shows the likelihood of obtaining a patent after the first final rejection. For example, for this particular examiner, Mr. John Kwon, one can quickly conclude that after the first final rejection, the examiner gets harder and his allowance rate drops significantly, meaning that he is more confident with his initial assessment of the application.

 

Comparison of allowance rate before and after the first final rejection with the art unit and USPTO - The second chart makes the same comparison of Allowance Rate before and after the first final rejection with the same art unit and the overall USPTO. For example for the same examiner, we can see that the examiner generally has a higher allowance rate before the first final rejection (higher than that of the same art unit or the USPTO). But after the first final rejection, it gets much more difficult to get the application allowed.

Effectiveness of RCE -  This chart compares the allowance rates of those applications with or without RCE. Hovering over the bar chart will show the total number of applications falling into each category. This is helpful to better understand if filing an RCE with a particular examiner improves the odds compared to that of the art unit or USPTO. 

 

Effectiveness of Appeal -  This chart compares the allowance rates of those applications with or without appeal. Hovering over the bar chart will show the total number of applications falling into each category. This is helpful to better understand if filing an appeal for a particular application will improve the odds for a particular examiner compared to that of the art unit or USPTO.

Effectiveness of Interview -  This chart compares the allowance rates of those applications with or without examiner interview. Hovering over the bar chart will show the total number of applications falling into each category. This is helpful to better understand if the attorney should consider talking to the examiner or the allowance rate is quite high without the interview process. It also compares that to that of the art unit or USPTO.

We have provided a list of all applications examined by each examiner at the bottom of the page. Users can browse through them and obtain more information by going to a particular application page.

 

Free Content

Besides the “Subscription-Only” content, Patexia is providing and updating several IP-related databases for our IP community, free of charge. This includes the following:

Requesting “New Projects” (Additional Services)

Patexia’s mission is to bring transparency and efficiency to IP. As part of its mission, we have created a very easy to use platform for patent attorneys to request a service and receive the deliverables directly through their online dashboard. 

Once the user is in their dashboard, they can request a “New Project” by clicking on the “New Project” button at the top of “My Projects” (dashboard) page:

At the moment, attorneys can request services in the following four categories:

Crowdsourced search and Analysis (Public Contest)

Patexia uses a global community of 20,000+ technical experts to solve many IP related problems. One of the methods we leverage the expertise of this powerful community is through crowdsourcing. This includes studies such as:

  • Validity Analysis

  • Evidence of Use Analysis

  • Patent Mining

  • Market Research

The expertise of our community spans a wide range from pharmaceutical and life sciences to deep technical fields such as telecommunications, computer science, etc. In terms of language, this community covers many languages from far east Asia (for example Japanese and Korean to German, French and English).

Our Concierge members can easily request a crowdsourcing study by selecting “Public Contest” and submitting a form provided for this kind of study.

Private Study and Analysis (prior art search, validity analysis)

If the client has a tight deadline or is looking for projects that is hard to do it public (e.g., patentability search) as the nature of the work requires non-public disclosure, we work with our experts in a private / offline setup. Some of the projects that are done this way, include:

  • Patentability Searches

  • Invalidity Searches

  • Freedom to Operate Searches

  • Landscape Analysis

Our Concierge members can easily request a private search by selecting “Private Study” and submitting a form provided for this kind of study. The cost for private studies vary depending on the study but additional discount is available for volume work.

Technical Consultant (Expert Witness)

Often times, and patent attorneys will seek expert’s opinion in the context of litigation or sometimes patent portfolio analysis. Patexia leverages its community of 20K+ experts for all kinds of expert consultation. This includes work related to:

  • Expert witness (testifying or non-testifying)

  • Expert consultation for patent portfolio acquisition

  • Expert opinion for infringement

Our Concierge members can request an expert consultant by selecting “Technical Consultant” and submitting a form provided for this kind of work. The cost for expert work is calculated on an hourly basis. 

Custom Insights Report

One of Patexia’s popular services is its custom IP analytics. Corporations and law firms work with us to perform various studies, using our Big IP Data. These are some examples:

  • Outside counsel evaluation for patent prosecution

  • Recommendation of litigation counsel (IPR, ITC, district court, …) based on past performance

  • Client or company insights for business development

  • Patent portfolio quality analysis (data-driven)

Because of the need for underlying data, this service is only available to our Concierge members. Any member could request a report by using the form provided in the user’s dashboard for this kind of study. The cost for this study is calculated on an hourly basis.
